The Gaming Commission (GC) has published an advice on "Article 42 of the Act of 28 November 2021 to make Justice faster, more humane and more punctual". You can view the full advice here (only available in French).
Summary:
"The GC advises the Government to issue a Royal Decree defining what constitutes a "strictly defined sideline activity" with respect to newspaper shops licensed by the GC to offer sports betting. The purpose of this advice is to limit the offer of betting, both in space and time, in order to protect players.
The GC proposes that only newspaper shops that have a (sufficiently) large supply of up-to-date press through a contract with a press distributor should be allowed to offer betting.
The GC also requests the Government to impose a certain percentage of the turnover from the sale of press articles on newspaper traders who want to offer betting.
The GC further advises that the offering of bets in a newspaper shop should only be possible during certain hours.
If the number of betting terminals allowed in a newspaper shop is limited, the GC asks the Government to also take into account the legitimate interests of the private gambling market, and to ensure that the monopoly of the National Lottery will not de facto apply to betting.
The GC once again urges the Government to ensure that the new rules are clearly formulated so that they can be efficiently monitored, both when a licence is granted/renewed and during on-site inspections.
Finally, the GC asks the Government and the Parliament to urgently proceed with a legislative initiative postponing the entry into force of Article 42 of the Act of 28 November 2021 until when the Royal Decree is adopted."
